 THIS SERVICE IS SUBJECT TO THE FOLLOWING:    

       

1. Mare must be halter broke. Mare/foal shall be healthy and in sound condition, free from infections, contagious, or transmissible diseases.  A current negative Coggins Test, veterinarian’s health certificate, plus a worming and immunization record must accompany the mare.  If they do not, Nelson Land and Cattle Company’s veterinarian will examine and/or test mare at Owner’s expense.  Nelson Land and Cattle Company, LLC. reserves the right to refuse service to any mare/foal not in proper condition.

2. Nelson Land and Cattle Company, LLC. agrees to diligently try to settle Owner’s mare.  The Mare Owner agrees to give the Nelson Land and Cattle Company, LLC. ample time to settle the mare.  If for any reason the mare does not settle rebreed privileges will be available.

3. Live Foal Guarantee: Shall pertain only to mares that are pronounced Safe In Foal by a Veterinarian within 90 days after the last breeding date.  A live foal is defined as one that will stand and nurse.  If the foal dies at birth, Mare Owner agrees to furnish Nelson Land and Cattle Company, LLC. within 7 days, a veterinarian’s certificate describing the occurrence.  In such a case, rebreed privileges will be available.

4. If the mare dies or becomes unfit to breed, the Mare Owner may substitute a mare.  Rebreed privileges will be available.

5. Rebreed Privileges are for the following year only.  The breeding fee will not be refunded. If the Mare Owner fails to return the following year, then any and all fees paid shall be forfeited, the right to rebreed is canceled and stallion owner is released from all obligation of this contract. 

6. If the above named stallion dies or becomes unfit for service for any reason, then this contract will be null and void and both parties are relieved of any further obligation.  Any monies paid by Mare Owner toward the Breeding Fee, with the exception of the  non-refundable Booking Fee that is included, shall be refunded to the Mare Owner if the mare is not settled or would qualify for rebreed privileges.

7. Mare Owner is responsible for all veterinarian fees.  Before the mare leaves Nelson Land and Cattle Company, LLC. all unpaid board, expenses, and fees become due and payable.

8. A Breeder’s Certificate will be issued for the foal when the mare has produced a live foal from this breeding and all expenses have been paid in full.

9. It is further agreed that Nelson Land and Cattle Company, LLC. shall not be held responsible for disease, accident, sickness or death of the mare and/or foal while under their care.

10.  Nelson Land and Cattle Company, LLC. will not hold Mare Owner responsible for any disease, accident, or injury to their stallions, mares, or foals.

11. If for any reason the mare does not settle, the Mare Owner will hold stallion owner and Nelson Land and Cattle Company, LLC. harmless.
